◊ For any Returns, refunds or reprint requests we must be notified immediately. These requests will only be honored within 7 days of the order being received and are subject to investigation and approval by Kioko Clothing Company's claims department.

◊ Promotional codes MUST be entered at the time of the order. If there is no promotional code associated with an order, then it will be charged for the full amount, no exceptions.

◊ Promotional codes may not be used on custom jobs including custom sizes, materials, quantities, or quotes.

◊ Promotional code use is up to the discretion of management on a per-order basis.

◊ By submitting your order for print, you agree that any and all files, artwork, creations, designs, ideas and concepts created physically or digitally may be used for marketing purposes such as video, photography, advertising and any other medium that DGI sees fit. You further agree that you legally own the copyright for the artwork or have received the explicit right to use the artwork.

Production Times

◊ All production times listed on this website are our best estimate.

◊ Delays, while rare, may occur due to, but not limited, to the following reasons: equipment malfunction, internet outages, power outages, supplier delays, file problems, computer glitches, etc.

◊ We will not guarantee production shipping times to meet a deadline unless specifically requested by the customer who will then be verified by one of our representatives in writing.

◊ The estimated production time starts when your order is verified, files are deemed usable, and begins printing.

◊ The estimated production time does not start when you submit your order, it starts when you have submitted all assets and the order has processed successfully.

◊ Weekends and Holidays DO NOT count as business days. The first business day is NOT the same day your order is placed but within the 24hrs which follows.

Rush Orders

◊ Rush Order Options are available. Kioko Clothing Company has the right to adjust shipping as necessary based on current work load and unforeseen circumstances on a case by case basis. If you have a very large order, anything for 50 physical items or digital printing orders over $450, please contact the company prior to making a rush request to determine availability. If a rush order is cancelled or declined the customer will receive email notification only with recommendations.

◊ Same day rush requests are available for an additional fee which can be added during checkout. The order will not be processed if the rush order fee is not present with the order.

◊ Same day Tshirt Transfer rush orders must be received by 11am EST to be processed the day in which the order is submitted. All same day orders submitted after 11am EST will be processed accordingly within one business day.

◊ Same day requests for Customized physical products should be approved prior to the customer placing an order. Submit your request to sales@kiokoclothingco.com before placing an order. Kioko Clothing Company makes no guarantee that same day rush orders will be processed if they were not approved in advance.

Shipping

◊ We are not responsible for lost or damaged packages unless Route Insurance is added to the package.

◊ We will not give refunds for lost, damaged, or late packages since this is a postal service and not the responsibility of Kioko.

◊ If your package is lost or late, we will file the necessary claim with Route Insurance or our shipping partner and re-print your order if necessary. Customers are required to submit hi-res, detailed photos of the packaging and all damaged items. No claim will be filed without the proper evidence from the customer.

◊ If your package is damaged beyond use, we will file the necessary claim with Route Insurance or our shipping company and re-print your order if necessary. Customers are required to submit hi-res, detailed photos of the packaging and all damaged items. No claim will be filed without the proper evidence from the customer.

◊ All shipping times are our best estimate.

◊ Shipping fees are nonrefundable.

◊ Shipping delays may occur because of, but not limited to, the following reasons: weather delays, transit accidents, data errors, customs, vehicle malfunctions, etc.

◊ We do guarantee on-time shipping based on the shipping policies posted for our company. Special exceptions have been identified for holidays and weekends.

◊ We do not guarantee any on-time delivery times because this is the postal service's responsibility and once shipped the delivery is out of our hands. Kioko Clothing Company provides estimated delivery times based on the postal service's listed timeframes and the date / time the customer finalizes their purchase and it processes successfully.

◊ Import duties, taxes and custom charges are not included in the item price or shipping charges. These charges are the buyer’s responsibility and will be added as necessary.

Shipping Insurance & Package Protection

◊ We are happy to announce that we have added Route Package Insurance as an option for all orders. Route protects all your packages no matter what class of shipping you choose. Route is completely voluntary but is recommended.

◊ To keep shipping costs as low as possible, Kioko Clothing Company will not offer package insurance on 1st class/ground shipped packages. This is where Route is recommended. Both USPS & UPS automatically offers insurance on limited service items up to a limited amount that is not to exceed $100. To view this information please visit the following link USPS Domestic Mailing Insurance or UPS Domestic Package Protection. To cover any amounts higher than the included coverage Route Insurance will need to be purchased (the different types of insurances cannot be combined).

◊ Insurance does NOT provide: Expedited delivery Guaranteed delivery time

◊ The cost of Route Insurance is based on your order total. The amount is displayed upfront in the checkout panel.

◊ Route Insurance is recommended for all DOMESTIC orders not covered under the USPS / UPS guidelines for insured packages. Route Insurance is recommended for ALL INTERNATIONAL shipping.

◊ Route Insurance is preselected but can be turned off with the toggle button or by selecting Remove in the Cart page. If the customer decides to remove the route insurance and their package is damaged during delivery, yet is not covered under one of the postal package protection services, they will not rate a claim or an exchange with our company. Therefore it is very important to add insurance so that your items are protected.

Returns

◊ You must contact us to receive an RMA number prior to returning your product. Start a return here.

◊ We do not accept unauthorized returns. All returns must be approved by Kioko Clothing Company.

◊ Acceptable reasons for returns explicitly are: damaged product, product is no longer useable due to missing a mutually agreed upon deadline, received the wrong product, product has errors or missing elements.

◊ A return does not mean you will receive a refund.

◊ If you are seeking a refund or a re-print you must return your entire order to us and receive approval for either a store credit or exchange.

◊ The RMA number must be written visibly on the outside of the package use to return the order.

◊ Return shipping is the responsibility of the buyer when damage is not the primary reason for the return or fault is not at Kioko Clothing Company. We will not reimburse any return shipping charges incurred.

Refunds

◊ Refunds are processed within 3-7 days of approval issued and normally issued within 3-5 business after processing.

◊ Any refunds over $200 will be issued via a company check and mailed to your billing address.

◊ If your product is returned within 7 calendar days of receiving it, and it meets our conditions for a refund, you will receive a refund as agreed upon minus any shipping fees that were charged with the order.

◊ Refunds are not given for products in the customer’s possession greater than 7 calendar days.

◊ To qualify for a refund one, or more, of the following conditions must be met: product is no longer useable due to missing a mutually agreed upon deadline, problems with the order were not fixed by file adjustments or reprints, customer is not overall satisfied with the printed quality of the product.

◊ Any orders which required design assistance will be refunded 50% of the total amount charged for the order.

◊ Return shipping is the responsibility of the buyer. We will not reimburse any return shipping charges incurred. Reprints

◊ A scanned image, photograph, or mailed sample showing defect must be sent in order to receive a re-print of your order.

◊ Your entire order, or the entire affected portion of the order, must be returned before we will reprint it.

◊ An order must be deemed, by a member of our staff, damaged, erroneous, or unusable to be reprinted.

◊ We may reprint your order only where extreme cases of color shifting cause the product to be deemed by us unusable.

◊ If an error with an order is deemed our fault then we will reprint that order right away using the original file provided.

◊ If new files must be provided, a new order must be created and billed to the customer.

◊ If an error with an order is deemed the fault of the customer, a new order may be placed at a discounted price.

Cancellations

◊ If the order is cancelled after it has been processed, 20% of the cost of the order will be billed. Customers have until the end of the day in which the order is made to cancel any custom order requests. Cancellations will not be processed or honored after these timeframes.

◊ Same day rush orders do not rate a cancellation since they are automatically moved to the front of the production line for processing.

◊ Next day orders can be cancelled within 1 hr from which the order is made. No cancellations will be processed for next day orders after the 1 hr deadline.

◊ If an order is processed and has begun printing, it will not be cancelled.

◊ If an order has been printed, pending shipment, or the customer no longer wants the order, paid shipping fees will be refunded only. Cancellations and refunds will not be provided for orders that have printed.

File Submissions

◊ Orders containing non-ready to print files will be placed on hold until a ready to print file in the correct the file format is submitted.

◊ You must request a proof at the time of placing the order. Proofs cannot be sent after an order has started production.

◊ You may receive a proof, even if you didn’t specifically request one, if we feel it is necessary before starting production.

◊ Colors in a digital proof are not guaranteed to match the finished product

◊ We cannot guarantee that the artwork will look exactly the same on your computer as it does on our equipment or the finished product.

◊ If the order details do not match the details of your submitted file(s) we will adjust the order details to match the file. In some cases this will cause a price change (increase or decrease) without notice.

◊ Please double check, revise, and fix any problems within your files before you submit your order. We are not able to make changes to your files once the order has entered production. If files need to be exchanged they must be done so by the end of the day in which the purchase is made. No changes will be allowed for same day orders. The file that is submitted is the file that will be printed unless notification is sent within 15 minutes of the order being made.

◊ Files must be submitted in SRGB color format with no foreign or vendor specific color profiles embedded.

◊ If you submit a file in another color format, we will convert it to SRGB or CMYK and exert our best effort to match colors.

◊ Color conversions may cause color shifting or files changes.

◊ We do not guarantee our CMYK colors will match the colors seen on your inkjet printer, your computer monitor, another printer, or any other Color Mode you specify.

◊ Submitting incorrect artwork will place your order on hold. You will receive one notification via email from the Quality department and are expected to correct any deficits identified. If not your order will remain on hold, be printed with the artwork submitted (there may be quality issues that Kioko will NOT be responsible for since all printing is based on the customer's artwork), or the order will be cancelled all at the discretion of Kioko Clothing Company.

◊ Files are generally kept on file for 3 months from the original purchase date. We attempt to hold on to all files. However, please keep in mind that files can be lost over the years due to many different factors (keeping track of Order Numbers will help and does expedite the process).

◊ By submitting your order for print, you agree that any and all files, artwork, creations, designs, ideas and concepts created physically or digitally may be used for marketing purposes such as video, photography, advertising and any other medium that DGI sees fit. You further agree that you own the copyright or have obtained the rights to use the file commercially.

Layout Service/ Custom Design

◊ Layout and Custom Design fees are nonrefundable. Promos and discounts do not apply towards Layout and Design fees.

◊ Layout Service–You may make up to 1 revision for free. Any subsequent revisions will result in a $10 charge per proof.

◊ Custom Design–You may make up to 2 revisions per design for free. Any subsequent revisions will result in a $10 charge per proof.

◊ Custom Design–You may request 2 design overhauls. Subsequent designs will result in a $30 charge per design.

◊ The Layout/Custom Design fees only pay for the labor that goes into creating the artwork. It does not pay for the copyright of the original artwork itself.

◊ Kioko Clothing Company retains the copyright of any designs created by its Custom Design service as well as the Layout Service. Artwork may be licensed to the customer at an additional payment amount upon mutual agreement. Custom Artwork Requests & Printing

◊ Kioko Clothing Company does not print trademarked or copyright designs unless the customer can provide certified documentation that they have received the exclusive right to use or reproduce the aforementioned material.

◊ Artwork is screened prior to printing and we do our best to identify both qualifying and none-qualifying designs. If it is identified that the customer has submitted copy-written files to be printed Kioko Clothing Company will place the order on hold, notify the customer that they can't submit copy-written work and therefore must provide legal documentation allowing them to use the artwork. The order will be placed on hold until the customer provides the required documentation and or cancelled and the order refunded.

◊ Although Kioko Clothing Company does our best to disqualify ineligible artwork during the quality check phase (checking for legal copyrights and trademarks only), there may be some times where artwork may make it through production by error. Each time the customer submits an order they are acknowledging that they have read these policies and do not hold Kioko Clothing Company liable for any artwork that is printed at their request. The customer accepts and guarantees that they own or have the explicit right to use any of the artwork that they request to be printed.

◊ We reserve the right to decline to print any artwork submitted at any time.

SMS/MMS Mobile Message Marketing Program Terms and Conditions

iConique Visualz Limited Company (hereinafter, “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in, subject to these Mobile Messaging Terms and Conditions (the “Agreement”).

◊ We may modify or cancel the Program or any of its features without notice. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts. We may also modify this Agreement at any time and your continued use of the Program following the effective date of any such changes shall constitute your acceptance of such changes.

◊ The Program allows Users to receive SMS/MMS mobile messages by opting into the Program, such as through online or application-based subscription forms. Your consent to receive automated marketing text messages is not required as a condition of purchasing any goods or services. Regardless of the opt-in method you used to join the Program, you agree that this Agreement applies to your participation in the Program. If you have opted in, the Program provides updates, alerts, information, promotions, specials, and other marketing offers (e.g., product discounts) from iConique Visualz Limited Company via text messages through your wireless provider to the mobile number you provided.

◊ SMS/MMS mobile messages may be sent using an automated telephone dialing system or other technology. Message frequency varies. You are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

◊ If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to reply STOP to any mobile message from Us in order to opt-out of the Program. You may receive an additional mobile message confirming your decision to opt-out.

◊ You understand and agree that the preceding options are the only reasonable methods of opting out.

◊ You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

◊ For any questions please text "HELP" to the number you received the messages from. You can also contact us for more information. If you wish to opt-out please follow the procedures above.

◊ We may change any telephone number we use to operate the Program at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

◊ The wireless carriers supported by the Program are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages, including, without limitation, notifying us immediately if you change your mobile number. You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the Program or from you providing us with a phone number that is not your own.

◊ If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the Opt-Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a required part of these terms and conditions.

◊ You further agree that, if you change your telephone number without notifying Us of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Us, or any party that assists in the delivery of the SMS/MMS mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs.

◊ You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Program, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so.
